These terms apply to this website and to goods and services supplied by IMF 3 Borehole Drilling JHB ("we", "us", "our"), Johannesburg, South Africa. By using the website or accepting a quotation from us you agree to them. They do not limit any rights you have under the Consumer Protection Act 68 of 2008 (CPA) or other South African law.
1. Our services
We supply and install borehole siting and drilling, solar borehole systems, JoJo tank and pressure pump installations, pump repairs and emergency water breakdown call-outs. Descriptions on the website are general. The scope, price and specifications for your job are those in our written quotation or invoice.
2. Enquiries and quotations
The website enquiry form only prepares a WhatsApp message to us. It is a request for information, not an order or a quotation, and it does not create a contract.
Quotations are valid for the period shown on them. Prices may change if the site inspection shows different conditions, if the scope changes, or if supplier prices change after the quotation expires. Photos and illustrations on the website are for illustration only.
3. Orders, payment and ownership
An order is accepted when you confirm the quotation in writing (including by WhatsApp or email) and any deposit stated in it is paid. Payment terms are those in the quotation or invoice.
Ownership of goods supplied stays with us until they are paid for in full. Risk passes to you on delivery or installation. Overdue accounts may attract interest and recovery costs as allowed by law.
4. Site access and installation
You must give us safe and timely access to the site, and make sure water and electricity are available where needed. You must tell us about any known hazards, existing faults or restrictions (for example in the plumbing, wiring or tanks). Delays caused by access or site conditions may change the timing and cost of the job.
5. Borehole siting, drilling and yield
Borehole siting and any hydro-geological survey is a professional estimate based on the information available. Groundwater is variable and we cannot guarantee that water will be found, or that a borehole will reach a particular depth, yield or water quality.
Your quotation will state how drilling is charged (for example per metre drilled) and what applies if a borehole turns out dry or low-yielding. Yield test results are measured on the day of the test and may change with season, rainfall and neighbouring abstraction.
You must point out the position of underground pipes, cables, tanks and other services before we drill, and you are responsible for any landowner consent. Boreholes may need registration or authorisation under the National Water Act and municipal by-laws. Unless we have agreed in writing to arrange this for you, obtaining it is your responsibility.
6. Emergency and call-out work
Response and arrival times we give for emergency call-outs are estimates only. They depend on your location, traffic, weather, load-shedding, parts availability and how many jobs are running at the time.
Emergency and after-hours call-outs may be charged at different rates from standard work. We will tell you the call-out basis before we dispatch where we can.
7. Warranties
Goods carry the manufacturer's or supplier's warranty, and we will help you lodge a claim where reasonable. Any warranty on our workmanship is the one stated on your quotation or invoice.
Warranties do not cover damage from misuse, lack of maintenance, power surges, running dry, freezing, unauthorised repairs or work by others, or problems that existed before our work. Nothing here removes your rights to goods that are of good quality and fit for purpose under the CPA.
8. Cancellations and returns
Special-order and custom-built items, and work already started, may not be cancellable or returnable except as the CPA allows. Cancellation charges and restocking fees, where they apply, will be reasonable and will be disclosed in the quotation. Any right you have to cancel under the CPA (including the cooling-off right for certain direct-marketing transactions) is not affected.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, or loss of production caused by a fault, delay or interruption. This does not exclude liability that cannot lawfully be excluded, such as liability for our gross negligence, or your rights under the CPA.
You are responsible for the ongoing care of equipment as recommended by us, and for keeping our service recommendations and records.
10. Use of this website
The website, its text, logos and images belong to us or are used with permission. You may not copy or reuse them for commercial purposes without our written consent. We try to keep the information accurate, but it may be out of date or contain errors. Please confirm the details with us before you rely on them.

12. Complaints and disputes
Please raise any complaint with us first on 060 878 2642 and we will try to resolve it quickly. If we cannot, you may approach the National Consumer Commission, the relevant ombud or tribunal, or a South African court.
13. Governing law and changes
These terms are governed by the laws of the Republic of South Africa. We may update them from time to time. The version on the website on the date of your order applies to that order.
